El consumo de drogas es una de las causas principales que han tra\u00eddo como consecuencia una gran cantidad de accidentes, raz\u00f3n por la cual, las autoridades espa\u00f1olas han tenido que adoptar nuevas medidas de seguridad con el fin de poder disminuir este tipo de riesgos.<\/span><\/p>\n

Seg\u00fan estudios estad\u00edsticos por las entidades gubernamentales han registrado que aproximadamente alrededor de un mill\u00f3n de personas consumen a diario algunas sustancias estupefacientes y psicotr\u00f3picas entre la m\u00e1s consumida se encuentra el cannabis sativa, nuestra legislaci\u00f3n presenta un vac\u00edo legal en cuanto se refiere al consumo de este tipo de sustancias, lo que ha producido un aumento desmedido en los accidentes de tr\u00e1nsito.<\/span><\/p>\n

Legalmente este tema ha sido muy controvertido, puesto que algunos jueces han manifestado que el uso de test que permitan detectar el consumo de drogas en el organismo en los conductores es anticonstitucional<\/strong>, en vista de que hasta la actualidad no existe ning\u00fan estudio que pueda demostrar que el consumo de esta sustancia sea la causa de que se produzca este tipo de accidentes.<\/span><\/p>\n

En contraposici\u00f3n encontramos que la mayor\u00eda de los accidentes que se producido en los \u00faltimos tiempos han provenido de personas que han consumido esta sustancia, lo que hecha de ver que, aun cuando no exista ning\u00fan tipo de estudio que as\u00ed certifiquen esta teor\u00eda, en la pr\u00e1ctica si ha quedado demostrado, pues, toda vez que ocurren accidentes, los conductores que se han visto involucrados en este tipo de hecho han resultado positivos en el consumo de drogas, as\u00ed lo ha determinado el informe presentado por el Instituto Nacional de Toxicolog\u00eda y Ciencias Forenses (INT) quienes manejan una cifra aproximada de 535 personas fallecidas a quienes se les practicaron la respectiva autopsia cuyo resultado arrojo positivo en droga y otras 532 personas resultaron positivo en consumo de alcohol, y la combinaci\u00f3n de estas dos sustancias con otros psicof\u00e1rmacos.<\/span><\/p>\n

La lucha en contra de este tipo de hechos comenz\u00f3 debido a la cantidad de denuncias que han recibido las entidades gubernamentales, y cantidad de personas que han fallecido en los \u00faltimos a\u00f1os, es por esta raz\u00f3n que han decido implementar estrategias que les permita regular este tipo de actos, con el fin de garantizar la seguridad.<\/span><\/p>\n

El Ministerio de justicia en su \u00faltimo reporte indico que entre los a\u00f1os 2008 y 2018 han observado un aumento en el consumo de drogas y f\u00e1rmacos de aproximadamente entre 10,7 % al 19,1 %, las cifras m\u00e1s alarmantes se presentaron en el a\u00f1o 2017 en donde alrededor del 44 % de las personas fallecidas hab\u00edan conducido bajo los efectos de las drogas, y otro 25 % de las muertas eran a causa del consumo de psicof\u00e1rmacos como la benzodiacepina, antidepresivos y antiepil\u00e9pticos.<\/span><\/p>\n

Entre las nuevas estrategias que se han implementado para detectar si una persona est\u00e1 conduciendo bajo los efectos de las drogas, se puso en marcha el uso de una tecnolog\u00eda que es similar al del alcohol\u00edmetro, el cual consiste en tomar una muestra de saliva del conductor y este se\u00f1alizar\u00e1 si es positivo o negativo<\/strong>.<\/span><\/p>\n

La implementaci\u00f3n de este sistema que ha sido denominado test indiciario salival, el cual, ha ocasionado molestias a cierto sector de la sociedad espa\u00f1ola, en virtud de no ser un m\u00e9todo infalible<\/strong>, pues seg\u00fan algunos medios de comunicaci\u00f3n han recibido denuncias por parte de conductores que han asegurado que sus resultados fueron positivos aun cuando no han consumido durante alrededor de 48 horas. Esto ha generado que se cree una pol\u00e9mica judicial, pues algunos abogados han manifestado que esta medida a\u00fan no se encuentra respaldada por ning\u00fan tipo de decreto que regule la materia, adem\u00e1s existe una diferencia bien marcada entre el alcohol y la droga, ya que este \u00faltimo no presenta una metrolog\u00eda que arroje resultados precisos.<\/span><\/p>\n
